Is that Dahlonega listing really a condo? How to check in four records

The short answer

Often it is not. In Georgia a condominium exists only when a declaration, plats and plans are recorded and the owners share undivided interests in the common elements. On Oct. 19, 2026 we could confirm two residential condominiums in Dahlonega. Before you treat a listing as a condo, check the state association register, the county parcel record, the recorded declaration and the HUD and VA lists.

Listing software has one box for property type, and agents pick the closest fit. In a town with very few condominiums, that box gets ticked “condo” for attached homes, small-lot townhomes and even detached cottages in a shared community. None of that makes them condos. In Georgia the word has a legal meaning, and it changes what you own, which law governs the association, how you insure it and which loans work.

Put simply, a condo is created by recorded paper, not by the shape of a building. Two homes that share a wall can be a condo, and two homes that share a wall can also be two separate lots. The only way to know is to look at the records.

Why it matters which one you are buying

The difference is not a technicality. It decides what is under your name on the deed and which statute your association answers to.

Condo or lot: the legal difference

  • Under the POA Act, owners own a 'lot' shown on a recorded subdivision plat; in a condominium they own a 'unit' plus an undivided share of the common elements. That is the core legal difference between a fee-simple townhome in an HOA and a condo. Official Code of Georgia (via FindLaw), checked 2026-10-19
  • Townhome and subdivision HOAs that opt in are governed by a different law, the Georgia Property Owners' Association Act (O.C.G.A. § 44-3-220 and following). Official Code of Georgia (via FindLaw), checked 2026-10-19

If the home is a lot, you usually own the ground under it and insure the whole structure yourself. If it is a condo unit, you own the unit plus a share of everything else, and the association insures the buildings under a master policy. Lenders treat the two differently as well: condo loans often depend on a review of the whole project. Our condo vs townhouse guide covers those differences in more depth.

Why Dahlonega has so few condominiums

A condominium takes more paperwork to create than a row of townhomes. The developer has to record surveyed plats and certified building plans before the first sale, form the association as a corporation, and write a declaration that meets the Act. Inside the city, zoning adds its own review.

What it takes to create a condo here

  • Before the first unit is sold, the developer must record surveyed plats and architect- or engineer-certified plans of the buildings that contain units. Official Code of Georgia (via FindLaw), checked 2026-10-19
  • In the City's R-2 Multiple-Family Residential district, residential condominiums are a permitted use (kept at least 50 feet from any R-1 boundary), subject to the condominium development rules in Sec. 1005. City of Dahlonega Code, checked 2026-10-19
  • City zoning requires new condominium developments to meet the Georgia Condominium Act and to submit proposed bylaws with the site plan; the City Attorney approves the format and content of bylaws and declarations. City of Dahlonega Code, checked 2026-10-19

A builder who wants attached homes can often sell them as fee-simple townhomes on platted lots instead, with a property owners’ association looking after shared areas. Plenty of small-town markets end up that way, and it is a big part of why a search for “condo” here returns so many homes that are not one. Our market explainer covers how to read a thin market without leaning on statistics that do not fit it.

What we found in Dahlonega

We checked the Georgia Secretary of State register, Lumpkin County parcel records, HUD’s FHA condo list and the VA condo report. Two residential condominiums came up with at least two independent records each, and both sit inside the city limits.

The two condominiums we could confirm

  • The Summit of Dahlonega Condominium Association is an active Georgia nonprofit corporation (control no. 07015699), formed 2/13/2007, principal office 264 Summit Drive, last annual registration 2026. Georgia Secretary of State, checked 2026-10-19
  • Lumpkin County's qPublic lists 32 parcels described 'THE SUMMIT OF DAHLONEGA #' plus a unit letter-number (buildings A through H, four units each) on Summit Drive, Summit Canyon Road, Summit View Spur and Summit Court, plus an association-owned clubhouse and common area parcel. qPublic Lumpkin County, checked 2026-10-19
  • Ida's Place Condominium Association, Inc. is an active Georgia nonprofit corporation (control no. 20016283), formed 1/28/2020, principal office 119 Boyd Cir. Georgia Secretary of State, checked 2026-10-19
  • qPublic shows ten parcels at 119 Boyd Circle labelled Unit A through Unit J, plus a parcel owned by Ida's Place Condominium Association. qPublic Lumpkin County, checked 2026-10-19
  • The Census geocoder places The Summit of Dahlonega (315 Summit Dr), Ida's Place (119 Boyd Cir) and Crown Mountain Place inside the Dahlonega city limits. U.S. Census Bureau Geocoder, checked 2026-10-19

A few other names show up in searches. Some are not residential, some are no longer active, and for some we found no condominium record at all. That last group may be good homes; we simply could not confirm that any of them is a condominium, so we do not describe them as one.

Names we checked and could not list as residential condos

  • Crown Mountain Place Condominium Association, Inc. (active, formed 6/28/2002, 81 Crown Mountain Place) appears to be an office/commercial condominium: qPublic lists units A100-E300 at 81 Crown Mountain Place owned by businesses such as a bank and a medical practice. Georgia Secretary of State, checked 2026-10-19
  • Three other Dahlonega-address condominium entities on the GA Secretary of State register are not active: Post Office Square Condominium Association (Admin. Dissolved, formed 2005), The Laurel-Dahlonega Condominium Association (Admin. Dissolved, formed 2020) and Turner Road Condo Association, LLC (Admin. Dissolved, formed 2020). Georgia Secretary of State, checked 2026-10-19
  • No Georgia Secretary of State condominium association with a Dahlonega address was found for 'Brookstone', 'Rock Pointe' or 'HawksNest/Hawks Nest' on Oct. 19, 2026. Georgia Secretary of State, checked 2026-10-19

Verified condominium · inside the city

The Summit of Dahlonega

The one Dahlonega complex confirmed by an active condominium association, unit-numbered county parcels, a HUD record and a VA acceptance.

  • Active condominium association
  • About 32 units per county records
  • VA accepted (May 2022)
  • Not on HUD’s approved list

Trade-off: HUD’s list shows its last FHA single-unit submission as rejected (2022), and we have not read its declaration, so rental and pet rules are unknown until you get the documents.

Check 1: the association on the state register

Georgia law requires a condominium association to exist as a corporation before the declaration is recorded, and its name has to say what it is.

A Georgia condominium association must be incorporated before the declaration is recorded, and its corporate name must include 'unit owners' association' or 'condominium association'. Every unit owner is automatically a member. (Official Code of Georgia (via FindLaw), checked 2026-10-19)

Search the association name on the Georgia Secretary of State business search. You are looking for an active nonprofit whose name includes “condominium association” or “unit owners’ association”. A “homeowners association” or “property owners association” points to a subdivision of lots instead. An entity marked dissolved is a reason to ask more questions, not a reason to assume.

Check 2: the county parcel record

Open the parcel on Lumpkin County’s qPublic and read the legal description. Condo parcels are usually described by the condominium name and a unit number, and the association often owns a separate common-area parcel. A description that reads like a subdivision lot, with its own acreage and a lot number on a plat, suggests fee-simple ownership.

Treat this as a strong pointer, not the last word. One of the two condominiums we confirmed shows a small acreage for each unit in the county records, which is unusual. That is why the next check matters most.

Check 3: the recorded declaration

Condominium instruments and their amendments must be recorded in every county where any part of the condominium sits (for Dahlonega, the Lumpkin County Clerk of Superior Court). (Official Code of Georgia (via FindLaw), checked 2026-10-19)

A Georgia condominium declaration must give the condominium a name that includes the word 'condominium' or is followed by 'a condominium'. (Official Code of Georgia (via FindLaw), checked 2026-10-19)

Ask the listing agent, or your closing attorney, for the recorded declaration with every amendment, plus the plat and plans. If the document is a “Declaration of Covenants” for a subdivision rather than a condominium declaration, you are buying a lot. We could not open the recorded declarations for any Dahlonega complex ourselves, so this step is yours to complete before the due-diligence period ends.

Check 4: the HUD and VA condo lists

The federal lists are not proof that a property is a condo. They do show that someone submitted it as one, and they matter for financing.

On Oct. 19, 2026, HUD's FHA condominium list showed three records for Lumpkin County and none with an 'Approved' status. The two Dahlonega records (Ida's Place and The Summit of Dahlonega) show 'Rejected Single-Unit Approval'; the third (The Heritage) shows 'Rejected'. (HUD FHA condo list, checked 2026-10-19)

On Oct. 19, 2026 the VA condo report returned only The Summit of Dahlonega for Lumpkin County (two records). No other Dahlonega condo appears on the VA list. (VA condo report, checked 2026-10-19)

Search the project yourself on HUD’s FHA condo lookup and the VA condo report, and give your lender the exact project name. Our FHA and VA condo guide explains what each status means.

Questions to send the listing agent

  1. Is the property a condominium under a recorded condominium declaration, or a lot in a subdivision? Please send the recorded document.
  2. What is the exact legal name of the association, and is it active with the Secretary of State?
  3. What is the parcel number, and does the legal description name a unit or a lot?
  4. Has the project been submitted to HUD or the VA, and when?
  5. Who insures the building exterior and roof: the association or each owner?

If the answers point to a townhome, that is fine. Many buyers want exactly that. Just shop it, insure it and finance it as what it is. Our is-it-really-a-condo tool walks through the same checks one question at a time.
