The condo declaration vs the City STR license: which one decides if you can rent?

The short answer

Both, and the stricter one wins. Rental limits for a condo live in its recorded declaration and amendments, which owners can change with a two-thirds vote. Inside Dahlonega city limits a short-term rental also needs an annual City STR license, and City zoning allows them in every district except R-1. A City license does not override a condo declaration, so read the declaration first.

Buyers who want to rent a Dahlonega condo by the night usually ask the City first. That is the wrong order. The City answers one question: whether short-term rental use is allowed on that property under its zoning and licensing rules. The condominium answers a different one: whether the owners have agreed to allow it in their building. You need a yes from both, and either can say no.

Layer 1: the recorded declaration

Every Georgia condominium declaration must state any restrictions on the general use of the condominium, or state that there are none. Rental limits, if any, are found here and in later amendments. (Official Code of Georgia (via FindLaw), checked 2026-10-19)

Georgia condominium instruments are generally amended only with the agreement of owners holding two-thirds of the association vote (or a larger majority if the instruments require it). From July 1, 1990, no amendment may require more than 80% of the owner vote. (Official Code of Georgia (via FindLaw), checked 2026-10-19)

A condominium amendment takes effect only when it is recorded (or on a later date stated in it). (Official Code of Georgia (via FindLaw), checked 2026-10-19)

Three practical points follow. First, read every recorded amendment, not just the original declaration, because rental rules are a common subject for amendments. Second, ask the association whether an amendment is being discussed or voted on now; minutes and notices will show it. Third, a rule that is not recorded yet is not in force yet, but it may be by the time you own the unit.

We could not open the recorded declarations for any Dahlonega complex, so we do not describe any complex’s rental rules. Ask the listing agent or your closing attorney for the recorded declaration, all amendments, the bylaws and any rules adopted by the board.

Layer 2: City zoning and the STR license

Both condominiums we could confirm sit inside the city limits, so the City’s rules are the ones to read.

The Census geocoder places The Summit of Dahlonega (315 Summit Dr), Ida's Place (119 Boyd Cir) and Crown Mountain Place inside the Dahlonega city limits. (U.S. Census Bureau Geocoder, checked 2026-10-19)

City of Dahlonega short-term rental rules

  • In the City of Dahlonega, a short-term rental means renting all or part of a dwelling (or another non-hotel structure) for 30 consecutive days or less. City of Dahlonega Code, checked 2026-10-19
  • City zoning allows short-term rentals in every zoning district except R-1 (Single-Family Residential). R-1 properties already used as STRs (or under contract with Airbnb or similar) on or before Aug. 15, 2020 may continue. In PUDs, the PUD text and approved site plan control. City of Dahlonega Code, checked 2026-10-19
  • Every short-term rental inside the city needs an annual Short-Term Rental License; the code sets the fee at $100 a year. The owner also needs a City occupation tax certificate and hotel-motel tax compliance. City of Dahlonega Code, checked 2026-10-19

The zoning district of a particular condo parcel matters here, and we did not confirm it for either complex. Ask the City which district the parcel is in before you count on short-term income. If a property is in a planned unit development, the PUD text and site plan control.

City operating rules

  • City STR rules limit occupancy to four people per bedroom and require one off-street parking space per bedroom; guest vehicles cannot exceed the on-site spaces. City of Dahlonega Code, checked 2026-10-19
  • City STRs must have a fire extinguisher on each level, interconnected smoke detectors, CO detectors, and a designated local contact available 24 hours a day whose details are given to the City, sheriff, fire department, police and owners within 300 feet. City of Dahlonega Code, checked 2026-10-19
  • Three code violations at one property within 12 months lead the City to revoke pending certificates and reject applications for that property for 12 months; violations carry a minimum $250 fine per offense. City of Dahlonega Code, checked 2026-10-19

The parking rule deserves attention in a condo. Parking is often a common element or a limited common element assigned by the declaration, so the number of spaces you can count as yours comes from the condo documents, not from the City. Read the full rules in the City Code, Appendix B, Article VIII.

Layer 3: lodging taxes

Taxes on short stays

  • The City of Dahlonega levies an 8% hotel-motel excise tax on lodging charges inside the city limits, with returns due by the 20th of each month. City of Dahlonega Code, checked 2026-10-19
  • Georgia adds a $5.00-per-night state fee on rooms and lodging rented by an innkeeper (stays over 30 consecutive days are exempt). Official Code of Georgia (via FindLaw), checked 2026-10-19

Budget for these as part of what guests pay and what you report. Ask the City how hotel-motel tax is handled when a booking platform collects it, because we did not confirm how platform remittance works for hosts inside the city.

The county license is a different system

A Dahlonega mailing address does not always mean a property is inside the city. Properties outside it fall under Lumpkin County’s rules, not the City’s, and the county license does not apply inside the city.

The county STR host license applies to all short-term rentals in unincorporated Lumpkin County (not inside the City of Dahlonega). Licenses expire December 31, must be renewed each year and are non-transferable. (Lumpkin County Code, checked 2026-10-19)

County STR hosts must certify that no deed restriction or covenant on the property prohibits short-term rental use. (Lumpkin County Code, checked 2026-10-19)

The county’s certification rule shows how the layers fit together: the county expects the host to confirm that no recorded covenant stands in the way. See the county’s Short-Term Rentals page for its current process.

County steps and limits

  • The county's Short-Term Rentals page says an approved Land Use Permit is required before a Business and Short-Term Rental License is issued. Lumpkin County, checked 2026-10-19
  • The county caps STR occupancy at two persons per bedroom plus two, and requires guests to park only in the driveway or garage. Lumpkin County Code, checked 2026-10-19

Outside the city, the county’s land use rules (its Land Use Code) come first, then the license. Neither the City nor the county process changes what a condo declaration says.

Long-term leases are a separate question

The City’s STR rules apply to stays of 30 consecutive days or less. A one-year lease to a single tenant is not a short-term rental under that definition, but it is still a rental, and a condo declaration can limit leasing of any length. Some declarations set a minimum lease term, a cap on how many units can be leased at once, or a waiting period for new owners. We do not know what any Dahlonega complex’s documents say, because we could not open them, so read yours for every kind of rental you have in mind.

This comes up often with buyers near the university, such as parents who want to house a student and rent the spare rooms. Our guide to buying near UNG walks through the questions to ask.

Layer 4: the lender

Rental use can also affect financing for the whole project. Lenders look at whether a building runs like a hotel.

Fannie Mae will not buy loans in condo projects run like hotels or motels, including projects that require owners to put units in a rental pool or that offer hotel-type services such as registration desks and daily or short-term rentals. (Fannie Mae Selling Guide, checked 2026-10-19)

That is about how a project operates, and we make no such claim about any Dahlonega complex. It is still a fair question for your lender if many units in a building are rented by the night.

Do not price the unit on rental income you have not confirmed

Sellers and online calculators sometimes quote what a unit “could” earn by the night. That number assumes every layer above says yes. If the declaration limits leasing, if the parcel sits in a district where the City does not allow short-term rentals, or if the unit cannot meet the parking rule, the income is not there. Make your offer on numbers that still work if the unit is only ever your own second home or a long-term rental, and treat short-term income as a bonus you confirm in writing during due diligence.

A checklist before you buy for rental income

  1. Get the recorded declaration, every amendment, the bylaws and the board’s rules. Find every clause on leasing or rental terms.
  2. Ask the association, in writing, whether any rental amendment is proposed, pending or recently recorded.
  3. Confirm with the City that the parcel is inside the city limits and which zoning district it is in.
  4. Read the City STR rules and count the parking spaces the condo documents actually give the unit.
  5. Ask your lender whether your rental plan affects the loan or the project review.
  6. Remember that any license is in the owner’s name; plan to apply for your own after closing.

City or county permission to run a short-term rental does not override a condo declaration. Start with the declaration, and treat the license as the last step, not the first. Our short-term rental guide and lock-and-leave guide cover the rest.

Questions buyers ask

Can I rent my Dahlonega condo on Airbnb?

It depends on three layers. City zoning lets short-term rentals operate in every district except R-1, with an annual City license. The condo declaration must state its use restrictions, and it can be stricter than the City. Read the declaration and its recorded amendments first.
